Facts of the Case
Our client was visiting a casino in the City of Detroit and walking through the main corridor. The carpeting had been recently replaced but an indentation beneath the carpet was not repaired. Our client stepped onto the soft area of the carpet, twisted her leg, and fell to the ground. She suffered a serious back injury and a broken foot as result of the fall.
Types of Injuries and Harm Suffered
- Back injury requiring surgery and physical therapy
- Broken right foot
- Pain and suffering
- Loss of enjoyment of life
- Disability
- Lost wages
- Medical bills
Legal Issues in the Case
- Was there a dangerous condition at the premises?
- Did the casino have prior knowledge of the defect?
- Was the Plaintiff partially at fault for the incident?
- How much compensation was appropriate for a settlement?
What We Did to Win the Settlement
We filed a lawsuit in the Wayne County Circuit Court in Detroit, Michigan against the casino. We did a physical inspection of the property, obtained surveillance video and obtained repair and maintenance records. We also took depositions of casino employees and witnesses. We also procured copies of all medical records and the amounts paid for medical treatment by the health insurance company.
We attended mediation and then a court settlement conference and agreed to a settlement of $485,000, which included medical expenses, lost wages, and physical therapy bills.
