Bone cement is widely used by orthopedic surgeons in joint replacement surgeries — including hip and knee replacements.

Although it is called cement, it does not actually harden like traditional cement. Rather, it is used to fill the space between the implant and the bone-like grout.

Is Bone Cement Safe?

There are more than a million joint replacement surgeries performed in the United States every year and bone cement is used in a large number them without any complications.  However, a significant number of problems associated with the medical product are being reported with more regularity.

What Are Known Complications of Bone Cement?

Some complications occur when the cement leaks into the bloodstream.  This is called bone cement implantation syndrome (BCIS), and causes:

  • Low blood pressure
  • Loss of consciousness
  • Blood clots
  • Pulmonary embolisms
  • Cardiac arrest
  • Death

Another complication is known as bone cement fragmenting. This causes a prosthetic implant to loosen from the bone.

When the cement fails or fragments, the patient suffers:

  • Pain
  • Instability
  • Decreased range of motion at the joint

In these situations, another joint replacement surgery may be necessary to alleviate the symptoms.

Claims Against the Product Makers

Lawsuits have been filed against the makers of bone cement.  The cases allege a number of different legal theories, including:

  • Designing, selling, and/or distributing a device that is defective and unreasonably dangerous.
  • No properly testing the safety of the product before selling and distributing it.
  • Failing to warn the public and medical community of the health risks associated with the device.

There are substantial documentation and evidence already in the hands of attorneys to support these claims of negligence.  There are very few viable legal defenses to disprove any of them.

Can I File a Bone Cement Lawsuit?

If you have suffered injury and harm due to bone cement, you can file a defective medical product lawsuit against the manufacturer.

There are no claims to be filed against your surgeon because the cement was likely used as recommended and approved.

Injuries occur even with correctly performed surgeries due to the bad product.

To prove your case, it must be proven that the specific product was used during your joint replacement surgery.

You must also prove you suffered one or more of the complications related to the product. This information will come directly from your medical records and radiology films.

How Much Are Bone Cement Settlement Payouts?

The amount of the settlement payouts is yet to be determined, but patients harmed by the product are expected to receive substantial compensation.

Many patients have been required to undergo additional procedures and even joint replacements because of the defective product.

Victims are entitled to compensation for the following:

  • Physical pain and suffering, including past, present, and future.
  • Psychological and emotional damages, including past, present, and future.
  • Medical bills and expenses.
  • Lost wages and income.

In cases involving a patient death, the family members can file a wrongful death lawsuit.
