		<title>Vergennes Township Plow Truck Accident</title>
		<description><![CDATA[<p>Two students were injured in a <a href="http://www.mlive.com/news/grand-rapids/index.ssf/2008/12/two_hurt_after_struck_by_plow.html">Vergennes Township plow truck accident</a>.&nbsp; The students were trying to pull a van out of the snow when they were hit by a private plow truck north of Bailey Drive on Lincoln Lake Avenue on December 23, 2008.&nbsp; They were injured, but their injuries were not life-threatening.<br /><br />I am sorry this accident occurred.&nbsp; Hopefully, these men make a full and quick recovery.<br /><br />These men should submit a claim for No Fault insurance benefits.&nbsp; No Fault insurance will cover all reasonable and necessary medical expenses arising from the accident, whether the expenses are incurred immediately or for follow-up treatment.&nbsp; This benefit alone could save each of them thousands of dollars.&nbsp; In addition, No Fault insurance will provide payments for lost wages, household replacement services, and other benefits.&nbsp; If either of them are at all unsure of what benefits they can claim, they should contact a lawyer to help them.<br /><br />If either of them are severely injured, they may be able to sue the driver of the plow truck for additional damages beyond what No Fault insurance will pay.&nbsp; Michigan law only allows people with very serious injuries to file lawsuits for car accidents, so they should speak with a lawyer to determine whether their injuries would qualify them to sue.</p>]]></description>

		<title>Attendant Care Benefits in Michigan</title>
		<description><![CDATA[<a title="Attendant Care Benefits" href="http://www.buckfirelaw.com/library/attendant-care-services.cfm" target="_blank">Attendant care benefits</a> in Michigan are provided to car accident victims under the <a title="Michigan No-Fault Insurance" href="http://www.buckfirelaw.com/practice_areas/michigan-nofault-insu.cfm" target="_blank">Michigan No-Fault</a> law.  These benefits are services provided to an injured person during their course of recovery and pay for the supervision, bathing, and caring for the accident victim. 		<title>Toy Safety Hazards | What Makes a Toy Dangerous</title>

		<title>Dangerous Toys</title>
		<description><![CDATA[<p>With the holidays approaching, many of the adults I know are busying giving and receiving advice about what toys to get their children.&nbsp; Sometimes the advice about what kind of toy NOT to get is even more important as the advice about what toy TO get.&nbsp; That is why I wanted to write this post.<br /><br />I recently received an email about a <a href="http://www.toysafety.org/worstToyList_index.html">list of dangerous toys</a>, which I wanted to share.&nbsp; The list is made every year by the World Against Toys Causing Harm, Inc., or W.A.T.C.H.&nbsp; I do not know much about W.A.T.C.H. but I do know they publish this list of dangerous toys every year around the holidays and that they have a standing list of potential toy hazards.&nbsp; I will write more on the toy hazards later.<br /><span style="text-decoration: underline;"><br /><strong>Ten Dangerous Toys</strong><br /></span><strong><br />Animal Alley Purse Pet</strong><br /><br />This toy is a soft toy sold to ages 0+, but its long hair is easily removed.&nbsp; This presents a potential choking hazard to young children.<br /><br /><strong>Ninja Battle Gear-Michelangelo</strong><br /><br />This toy is part of a set that allows children ages 4 and up to dress up like ninjas and fight with their weapons.&nbsp; Children can easily be hurt if one end of Michelangelo's nunchuks hits them.<br /><br /><strong>Walk'n Sounds Digger the Dog</strong><br /><br />This toy features a pull cord that activates barking and other dog sounds.&nbsp; Although the toy is marketed to children ages 12 months+, its 26 inch length cord presents a choking hazard to young children.&nbsp; This is very remarkable since most toy manufacturers voluntarily limit cords on cribs and playpens for children that age to 12 inches or less.<br /><br /><strong>Pucci Puppies - My Own Puppy House Golden Retriever</strong><br /><br />Small dog toys such as a bone, cookie, and chew toy could easily fit in a toddler's mouth and therefore present a choking hazard.<br /><br /><strong>Meadow Mystery Play-A-Sound Book with a Cuddly Pooh</strong><br /><br />The Winnie the Pooh doll comes with a mystery mask that presents a choking hazard to young children.&nbsp; Although the packaging indicates the product has been safety tested for children age 18 months and up, the doll indicates it is safe for all levels.&nbsp; Parents should be aware of the inconsistency.<br /><br /><strong>Inflatable Giga Ball</strong><br /><br />Children 4 and up can crawl inside this inflatable ball to tumble and bounce around, but they can be hurt while bouncing around.&nbsp; One set of warnings advises not to use the toy on hills or near water and states parental supervision is required.&nbsp; The toy itself indicates parental supervision is merely recommended while the package insert states the product should not be used as a flotation device or by the pool.<br /><br /><strong>Adjustable Toy Skates</strong><br /><br />Warnings on the packaging state a child using the toy skates should wear knee pads, elbow pads, wrist guards, and a helmet.&nbsp; The safety gear that comes with the toy, however, only includes knee pads and elbow pads.<br /><br /><strong>Sportsman Shotgun<br /></strong><br />This is a realistic looking gun that allows a child to load and then shoot rubber bullets.&nbsp; There is a serious potential for eye injuries, injuries to pets, injuries to other children, and other injuries.&nbsp; The packing recommends the toy for children ages 14+ but further states it is not recommended for children younger than 3.<br /><br /><strong>Extreme Spiral Copters</strong><br /><br />This toy allows children to launch a spinning helicopter into the air with a rubber band.&nbsp; This carries all the hazards that a traditional sling shot would, including injuries to the child using the toy if the band breaks or snaps backward and injuries to people or animals in the projectile/helicopter's path.<br /><br /><strong>Go Go Minis Pullback Vehicle</strong><br /><br />The rear wheels of these miniature trucks and cars can be removed, and they present a choking hazard to children.&nbsp; 		<title>Lenawee County Car Accident</title>
		<description><![CDATA[<p>A <a href="http://www.lenconnect.com/news/x1009163118/No-serious-injuries-in-crash">Lenawee County car accident</a> has destroyed a sheriff's car but resulted in only minor injuries.&nbsp; The accident occurred on December 10, 2008 when Lenawee Sheriff's Deputy Nathan Adams entered the intersection of Deerfield Road and Rogers Highway.&nbsp; Guadalupe Lizcano of Blissfield supposedly ran through a stop sign and hit the deputy's car broadside.&nbsp; The cause of the accident is still under investigation.&nbsp; Fortunately, neither the deputy nor Guadalupe Lizcano suffered more than minor injuries.<br /><br />I am very sorry this accident occurred.&nbsp; Fortunately neither driver was seriously hurt.<br /><br />The news report seemed to indicate that Guadalupe Lizcano was at fault for running a stop sign.&nbsp; This does not seem to make sense since the same report indicates Guadalupe Lizcano hit the sheriff's car broadside, which would mean that the police car was already in the intersection when he came to the stop sign.&nbsp; The important thing to know here is that regardless of fault, Michigan No Fault insurance benefits are available to anyone injured in a car accident.&nbsp; No Fault insurance will pay for any medical expenses to treat this man's injuries from this car accident.&nbsp; If his injuries were more severe, he could submit claims for additional benefits, but he probably will not need to for this accident.<br /><br />If Guadalupe Lizcano had been seriously injured, he might want to sue the police for additional damages beyond what his No Fault insurance would pay.&nbsp; If that were the case, it would be important to realize that the determination of fault from the police report is not definitive.&nbsp; Instead, a judge or jury is the one who makes the definitive determination of fault.&nbsp; Michigan law requires an accident victim to suffer death or very serious injury before they can sue.&nbsp; Since whether an injury is serious enough will vary with each accident, Guadalupe should speak with a lawyer about his accident.</p>]]></description>

		<title>Kalamazoo Hit and Run Car Accident</title>
		<description><![CDATA[<p>A <a href="http://www.mlive.com/kzgazette/news/index.ssf/2008/12/kalamazoo_public_safety_looks.html">Kalamazoo hit and run car accident</a> has injured one man.&nbsp; The accident occurred on December 10, 2008 near West Michigan Avenue and Kenbrooke Court at around 1:00am.&nbsp; Police found a pedestrian who had suffered non-life-threatening injuries lying in a snow bank following the accident.&nbsp; Police are still looking for the hit and run driver, who is believed to be driving a white midsize car that is missing a passenger side mirror.&nbsp; Several large pieces of plastic were broken off its front bumper.<br /><br />I am very sorry this accident occurred.&nbsp; I hope this man is able to experience a full recovery.&nbsp; The article makes it sound like his injuries are minor, but given the property damage to the car, the impact must have been very serious.<br /><br />Even though the man that was injured was a pedestrian, he can still submit a claim through his car insurance for the injuries he has sustained in this accident.&nbsp; If he submits a claim to his Michigan No Fault insurance company, the insurance will pay for all of his medical expenses including his current hospital bills and any reasonable and necessary follow-up treatment caused by the accident.&nbsp; No Fault insurance will pay for a portion of his lost wages as well as other benefits depending on the severity of his injuries.<br /><br />This man may be able to file a lawsuit against the hit and run driver for additional damages.&nbsp; Michigan law allows only those who are very seriously injured to sue a negligent driver, so this man should speak with a lawyer about his injuries to see if he has a case.&nbsp; If the man has uninsured motorist insurance coverage, he may be able to submit a claim to that insurance policy instead of suing the other driver.&nbsp; Again, he should talk to a lawyer to determine if he should do this.</p>]]></description>

		<title>Wayland Township Car Accident</title>

		<title>Farmington Hills Car Accident | David Shu-Kin Kwok</title>

		<title>Dearborn Postal Truck Accident Causes Death</title>

		<title>Tuscola County Car Accident</title>
		<description><![CDATA[<p>A <a href="http://abclocal.go.com/wjrt/story?section=news/local&amp;id=6523133&amp;rss=rss-wjrt-article-6523133">Tuscola County</a> car accident has resulted in the death of a woman.&nbsp; The woman was struck by a car on Bray Road north of Willard Road in Arbela Township.&nbsp; The accident occurred at about 6 pm on November 24, 2008 and there were several neighborhood witnesses.&nbsp;<br /><br />I am very sorry that this accident occurred.&nbsp; The news report indicated that the woman was in her mid to late thirties when she died.&nbsp; She should have had her whole life ahead of her.&nbsp; My sympathies go out to her family for their loss.<br /><br />In an accident like this, the family should probably do two things as soon as they reasonably can.&nbsp; First, they should submit a claim for No Fault insurance survivor benefits.&nbsp; This will provide them with a payment for part of the funeral.&nbsp; It will also provide payments for loss of financial support and loss of household services, which are her wages or income and the value of household chores she performed, respectively.&nbsp; Survivor loss benefits can provide near-immediate assistance to a family, especially one facing the loss of income of a working parent or of a homemaker who took care of the house so others did not have to.<br /><br />The second thing the family should do is to speak with a lawyer about filing a lawsuit for wrongful death.&nbsp; This could allow them to collect damages for their pain and for loss of companionship of this woman.&nbsp; It would also allow them to collect damages beyond what is allowed by their No Fault company.&nbsp; In fact, a lawyer can help assemble all the documents for a survivor loss claims as well to ensure they get all the benefits they are entitled to.</p>]]></description>

		<title>Ogemaw County Truck Accident | Ann Arbor Truck Accident Lawyers</title>

		<title>Detroit Truck Accident Settlement</title>

		<description><![CDATA[<p>Going to the shooting range is a great way to practice for hunting deer, but there may be some hidden risks of shooting for a long period of time.&nbsp; According to a study I recently read, many shooting ranges have poor ventilation which increases the risk of injury from lead exposure.&nbsp; Lead used to be found in gas and paint, but it was banned in those products several decades ago because of the very serious health-risks it presents, especially to children.&nbsp; To learn more about the health effects of lead, visit the <a href="http://www.buckfirelaw.com/practice_areas/child-lead-poisoning.cfm">lead poisoning injuries</a> section of my law firm's website.&nbsp;<br /><br />The study, put on by the <a href="http://www2a.cdc.gov/nioshtic-2/BuildQyr.asp?s1=00199081&amp;PageNo=1&amp;RecNo=1&amp;View=f&amp;">National Institute of Occupational Safety and Health</a>, indicates that many shooting ranges, especially those with low ceilings, have very poor airflow.&nbsp; The problem is made worse by tight corners, large ornaments or displays, and other barriers to air circulation.<br /><br />Poor airflow on a shooting range becomes a problem for the gun user when smoke from discharges fills the air near the shooter.&nbsp; Particles of lead from the ammunition clog the air and can enter the body during the normal breathing process.&nbsp; This can cause lead to enter the blood stream and be transported throughout the body and to the brain.&nbsp; At high levels, adults can suffer loss of IQ points and other brain damage.&nbsp; In children, brain damage occurs at much lower levels and other developmental disabilities can begin.&nbsp; In fact, several recent studies suggest that lead is unsafe at any level for a child.</p>]]></description>

		<title>Hot Coffee Burn Injury Cases | Michigan Burn Injury Lawyers</title>

Mrs. Liebeck's car was not moving; it was parked. Her son-in-law was driving. Not her.<br />2. The <strong>coffee was scalding</strong> (180-190 degrees) which can cook all layers of skin within 7 seconds. It was not as hot as normal coffee (135-140 degrees).<br />3. Mrs. Liebeck asked for payment of her medical bills before filing suit. She did not want to sue.<br />4. She spent <strong>eight days in the hospital</strong> and had painful skin grafts and debridement treatments.<br />5. Her genitalia and buttocks had third degree burns. The skin on those sensitive places of her body had to be peeled off, then other skin from her body had to be peeled off and then placed on her genitalia and buttocks.<br />6. McDonald's rejected her offer and then mediation, insisting on a trial.<br />7. McDonald's admitted its coffee was 40 to 50 degrees hotter than is fit for human consumption.<br />8. Mrs. Liebeck suffered third-degree burns over 6 percent of her body.<br />9. McDonald's knew more than 700 people, including babies, had been burned by its coffee.<br />10. McDonald's told the jury it wouldn't lower its coffee's temperature, prompting the jury to punish the corporation.<br />11. The jury awarded $200,000 for "out of pocket" economic damages, reduced to $160,000 because it found Mrs. Liebeck 20 percent at fault.<br />12. <strong>The jury's decision to punish McDonald's with $2.7 million in punitive damages for blatant misconduct was reasoned</strong>: That's two days of coffee sales for McDonald's.<br />13. At trial, Judge Robert Hayes Scott reduced the punitives to three times actual damages--$480,000.10. Post-verdict mediation was ordered, the case settled, and there was no appeal.<br />11. McDonald's immediately lowered the temperature of its coffee.<br /><br /><br />The jury heard all of these facts during the trial.&nbsp; The public has been unaware of these facts and the public opinion of this case has been tainted by misinformation given by big business and insurance companies.<br />Burn injuries are very serious and often life changing.&nbsp; <br /><br />It is important that anyone who suffered burn injuries from the negligence of a person or business to contact an experienced law firm, like our firm, to assist them in making their claim and to refute the&nbsp; misinformation that will be given by the Defendants.&nbsp; Burn injury victims should not be embarrassed from filing these claims because other people might think it was their own fault being burned.&nbsp; This is usually not the case.]]></description>

		<title>Black Ice Case Opinion | Michigan Slip and Fall Lawyers</title>
		<description><![CDATA[<p>Michigan lawsuits involving slip and fall cases on black ice were being dismissed by the trial courts based upon the "open and obvious" doctrine.&nbsp; This basically means if the injured person can see a hazard before stepping on it, then the property owner has no legal duty to prevent the hazard.&nbsp; This, of course, is absurd and has lead to absurd results, especially in black ice cases because by its very definition the hazard cannot be seen.<br /><br />Well, the Michigan Court of Appeals has finally set the record straight by declaring that in most instances, black ice cases cannot be dismissed due to the open and obvious doctrine.&nbsp; The case is Slaughter v. Blarney Castle Oil Co. (Michigan Court of Appeals) (Lawyers Weekly No. 07-68180 - 6 pages (published) (Beckering, J., joined by Borrello and Davis, JJ.)&nbsp; An excerpt of the court opinion is below<br /><br />"In this case of first impression, the Michigan Court of Appeals concludes that black ice, without the presence of snow or evidence that the black ice would have been visible on casual inspection prior to the fall, is not an open and obvious danger.<br />"The overriding principle behind the many definitions of black ice is that it is either invisible or nearly invisible, transparent, or nearly transparent. Such definition is inherently inconsistent with the open and obvious doctrine. Consequently, we decline to extend the doctrine to black ice without evidence that the black ice in question would have been visible on casual inspection prior to the fall or other indicia of a potentially hazardous condition.<br />"With regard to whether other evidence of an open and obvious danger existed in this case, there was no snow on the ground, and it had not snowed in a week." The parking lot was paved with black asphalt.<br />"Prior to alighting from her truck, plaintiff did not observe anyone else slip or hold onto an object to maintain his or her balance. She did not see the ice before she fell, and could not readily see it afterwards. Although it was starting to rain at the time of plaintiff's fall, the danger and risk presented by a wet surface is not the same as that presented by an icy surface.<br />"Contrary to defendant's assertion that the mere fact of it being wintertime in northern Michigan should be enough to render any weather-related situation open and obvious, reasonable Michigan winter residents know that each day can bring dramatically different weather conditions, ranging from blizzard conditions, to wet slush, to a dry, clear, and sunny day. As such, the circumstances and specific weather conditions present at the time of plaintiff's fall are relevant. We are not persuaded that the recent onset of rain wholly revealed the condition and its danger as a matter of law such that a warning would have served no purpose."</p><br />
This case now gives a legal remedy for damages for victims of slip and fall on black ice cases in Michigan.&nbsp; With cold weather just around the corner and snow and ice on the way, this opinion has arrived just in time.]]></description>

		<description><![CDATA[A jury has awarded a <strong>brain damaged boy</strong> $11.4 million dollars in a Wisconsin court after a lengthy trial.&nbsp; The lawsuit alleged that the hospital and a midwife were negligent in the delivery of the child and this caused permanent and irreversible brain damage.&nbsp; The hospital, of course, denied any wrongdoing.<br /><br /><strong>Birth injury cases</strong> involving cerebral palsy and other type of brain damage to babies typically involve significant damages because of the lifetime of special care and medical treatment that will be required throuhgout the baby's lifetime.&nbsp; Even as an adult, the child will often require in home supervision or even placement in a special facility.&nbsp; The cases are very tragic and result in million dollar awards and settlements when the injury is due to the negligence of a medical provider.]]></description>

		<title>Grand Rapids Car Accident</title>
		<description><![CDATA[<p>A <a href="http://www.mlive.com/grpress/news/index.ssf/2008/10/man_seriously_injured_after_ca.html">Grand Rapids car accident</a> has resulted in serious injuries for a 29-year old Grandville man.&nbsp; Kevin Vangilder was seriously injured in a car accident that occurred at Eastern and Colbrook early morning on October 26, 2008.&nbsp; He was riding in the backseat of a car involved in an accident and was not wearing his seatbelt.&nbsp; He was thrown into the car's windshield and is being treated for head injuries.&nbsp; The driver, a 39-year old woman from Grand Haven, suffered non-life threatening injuries.&nbsp; A front seat passenger was not injured in the accident.&nbsp; It is unclear what caused the accident, and police are still investigating, although alcohol is believed to be a factor.<br /><br />It is a real tragedy that this accident happened and that the injuries were so severe.&nbsp; I hope that Kevin Vangilder and the driver are able to experience a full recovery from their injuries.<br /><br />My law firm represents people injured in car accidents.&nbsp; Both people injured in this accident are eligible for Michigan No Fault insurance benefits.&nbsp; No Fault insurance will pay for all medical expenses and a portion of any wages lost because of the accident.&nbsp; No Fault insurance may also provide them with additional benefits depending on the severity of their injuries.&nbsp; Additionally, if Kevin Vangilder's injuries are very severe, he may be able to sue his driver for additional damages.&nbsp; Although my clients are sometimes hesitant to sue someone they know, I always remind them that the lawsuit is actually against the driver's insurance company.&nbsp; Finally, if alcohol was in fact involved, Kevin Vangilder may be able to sue a bar or restaurant that served the driver alcohol.</p>]]></description>

		<title>Clawson Car Accident | Drunk Driver Hits Bicyclist</title>
		<description><![CDATA[<p>A suspected <a href="http://www.dailytribune.com/articles/2008/10/19/news/srv0000003825798.txt">drunk driver from Troy struck a bicyclist from Clawson</a> last week.&nbsp; The accident occurred near 14 Mile Road and Main Street when the driver pulled out of a parking spot near the Black Lotus Brewery.&nbsp; The bicyclist had been riding his bicycle in the northbound lane of Main Street.&nbsp; The man was transported to Beaumont Hospital with internal injuries and severe head trauma.&nbsp; Weather conditions and roadside construction may have contributed to the accident, however, the driver also blew a 0.17 on a preliminary Breathalyzer test, which is over twice the legal limit.<br /><br />This is a truly senseless accident and I was very sorry to have read about it.&nbsp; I hope that the bicyclist has a complete and speedy recovery.<br /><br />Too often, I encounter people who do not know what rights they have when they are involved in a car accident.&nbsp; They frequently do not realize that Michigan law offers them some many recourses if they have been severely injured.&nbsp; Michigan No Fault insurance provides for payment of all medical expenses including the hospital bills incurred at the time of the accident and any reasonable and necessary medical expense required by the accident.&nbsp; No Fault insurance also covers a portion of lost wages, payment for household replacement services, and payment for supervised attendant care after a patient is released from the hospital.<br /><br />In addition, people who are seriously injured can sue the other drivers for negligence, and when a drunk driver is involved, they may be able to sue the bar or restaurant that served the drunk driver alcohol.&nbsp; The best way to determine someone's rights after a car accident would be to consult an experienced Michigan car accident lawyer.</p>]]></description>

		<title>Northfield Township Bus Truck Accident Hurts Amish</title>
		<description><![CDATA[<p>A <a href="http://www.detnews.com/apps/pbcs.dll/article?AID=/20081009/METRO/810090471">Northfield Township bus accident</a> has resulted in minor injuries for at least 14 members of a Mount Pleasant Amish church.&nbsp; The accident occurred when a tour bus was rear-ended by a semi tractor-trailer on U.S. 23 near Barker Road north of Ann Arbor.&nbsp; More than 20 people were crammed in the 13-passenger tour bus.&nbsp; The 14 were taken to the University of Michigan Hospital, but 8 people refused treatment for minor injuries.<br /><br />This is a pretty alarming tragedy and I am sorry it happened.&nbsp; Although many people were injured, it sounds like their injuries were relatively minor.&nbsp; This is very fortunate for a couple of reasons.&nbsp; First, accidents involving semi-trucks tend to be very bad accidents.&nbsp; Second, buses are usually not equipped with seatbelts and other safety features now standard in cars.&nbsp; A bus-truck combination accident has the potential to be a very serious accident but fortunately it sounds like no one was critically injured in this accident.<br /><br />Everyone involved may have a claim for Michigan No Fault insurance benefits.&nbsp; As passengers, the Amish may be able to make a claim through the bus driver's insurance policy.&nbsp; This will pay for the medical expenses for those who received medical treatment.&nbsp; In addition, if anyone had been seriously hurt, other benefits would have been available.&nbsp; Finally, if any of the Amish had been very seriously injured or killed, they would have a claim directly against the negligent driver for damages in excess of what their No Fault benefits would provide.</p>]]></description>

		<title>Grand Rapids Hit and Run Car Accident</title>

		<description><![CDATA[<p>A <a href="http://www.whmi.com/news/article/7278">Northfield Township car accident</a> has left a South Lyon woman dead after shutting down North Territorial Road for hours on Wednesday.&nbsp; An elderly South Lyon couple were apparently lost and turned their vehicle onto Beverly Lane to turn around.&nbsp; The accident occurred when the driver pulled his vehicle out too far into the path of a pickup truck traveling down North Territorial.&nbsp; Both were taken to Ann Arbor area hospitals.&nbsp; The wife died later that evening while her husband remains in critical, but stable, condition.<br /><br />This is very tragic and I have nothing but sympathy for this family.&nbsp; I hope that the man is able to recover from his injuries.<br /><br />My law firm represents people injured in car accidents, and I can tell you this situation is more common than one might think.&nbsp; The family of this couple should file a claim for No Fault insurance which will cover all the hospital bills and other medical expenses.&nbsp; In addition, the survivor loss portion of the No Fault claim will give a payment to cover a portion of the funeral costs for the deceased.&nbsp; Other benefits may also be available.&nbsp; Finally, the family should seriously consider suing the at-fault driver for wrongful death on behalf of the deceased.&nbsp; Although the news reports m
